What is divorce tourism? Very good question. If I had to hazard a guess, I would say it’s semantic calisthenics and it’s really just another way of saying, “forum shopping.” In New York, for example, you would try to get a divorce in a county that has a reputation for being friendly to your particular cause. Across the pond, in UK, which is where I think the term originated, it means going to another European country, set up residency, get a divorce that is more favorable than if you stayed in your own country. So, for example, Italian laws seem to be a bit stricter than, say Sweden, or Britain. So what would an Italian couple who had the means do? Leave Italy if they have divorce on the cerebral cortex. Set up residency in Sweden or Britain, or anywhere other than Italy, and after six months, file for divorce in the foreign country in order to get a more favorable result–or even, simply, to actually get the divorce. That, as far as I can tell, is what “divorce tourism” is all about.
