Divorce Saloon: What is your area of specialization if any within the realm of your matrimonial practice ?
Vivien Stark: Divorce, child support, custody and prenuptial agreements.
Divorce Saloon: How long have you been an expert in this area?
Vivien Stark: I have devoted 27 years to the practice of matrimonial and family law.
Divorce Saloon: What attracted you to this type of work?
Vivien Stark: Divorce and family law is about working directly with clients. I believe that I have the ability to listen to a client and quickly figure out what needs to be done to help the client. There is never a day that goes by that I don’t either learn something new or encounter a different situation.
Divorce Saloon: What is new and different in the last 5 years or so in the field?
Vivien Stark: Same sex marriage, divorce and prenuptial agreements is what’s new today. In addition, more affluent couples are having children outside of marriage.
Divorce Saloon: What needs to be new and different in the field in your opinion?
Vivien Stark: I think that there needs to be revisions made to the child support laws so that the law is fair to both the custodial and non-custodial parent. As the law stands now, even when parents have equal time with their child, the parent earning more money pays the same amount of child support to the other parent as a parent spending only minimal or no time with his or her child.
Divorce Saloon: How has technology and the digital revolution affected your practice, if at all
Vivien Stark: Technology has radically changed the practice. “Paperwork” can be completed much more efficiently with the use of computer programs. In my field, many divorces have been caused by the ease of meeting others on line. At the same time, cell phones and computers leave proof of infidelity allowing the other spouse to prove what would otherwise be nothing more than suspicions.
Divorce Saloon: Would you advise young lawyers getting out of law school to specialize in matrimonial law? Why or why not?
Vivien Stark: I would advise young lawyers to specialize in matrimonial law, however I would tell them to make sure that they cared about their clients and were knowledgeable about the area of law prior to taking a case. There are too many lawyers working in this field with too little experience. Taking a case that you are unqualified to handle is a disservice to your client.
Divorce Saloon: Do you think that clients should rely on “reviews” on Internet sites to choose a divorce attorney? Why or why not?
Vivien Stark: That’s a hard question. I believe that unsatisfied clients have more of a tendency to leave reviews for lawyers due to the personal nature of the service. On the other hand, I have had happy clients want to leave a good review as an expression of their satisfaction with the services of our firm. This area of law is one where emotions run very high. I think reviews are just one factor to be used in accessing a lawyer.
Divorce Saloon: What is the profile of your ideal client?
Vivien Stark: An ideal client is one with reasonable expectations, responsive to our requests for documents and information and above all else, patient with the process.
Divorce Saloon: What is the profile of your worse nightmare client from hell?
Vivien Stark: Narcissistic, very angry and rude with an unrealistic expectation of the legal process. Thankfully, most clients are very nice people who do not exhibit the above traits.
Divorce Saloon: Which divorce lawyer to you most admire and why?
Vivien Stark: I really do not have one divorce lawyer that I most admire, however I would say that I admire all lawyers who give back to the community by either teaching Continuing Legal Education or providing pro bono legal services to lower income individuals.
Divorce Saloon: What do you wish you knew before you became a divorce lawyer?
Vivien Stark: I really can’t think of anything since I’ve been a divorce lawyer for so long. I believe that you either love practicing this area of law or hate it. You need to have a good sense of humor along with a strong desire to help people.
Divorce Saloon: Which quality do you think is most important in a divorce attorney and why? (Experienced, top-rated, empathetic, tough, peer-endorsed, etc)
Vivien Stark: I think experience in the field is the most important quality, however experience is just the starting point. After that, you need an attorney that cares about the client and sets the clients goals and needs as the primary focus in any case.
