Why doesn’t the Hague Convention apply?
We posted on this story months back when it first broke. American David Goldman married a Brazilian woman and they lived here in the US. She bore him a son named Sean. One day she left for holiday to see family in Brazil, with Sean, and never came back. She refused to give David access to the boy and she divorced David in the Brazilian courts.
By a strange twist of fate, the ex wife remarried and died last year during child birth. So David believed that his son Sean Goldman should be returned to his custody after years of “abduction” by David’s ex wife. But not so. The wife’s new husband/widower refuses to give Sean back to his dad David.
Poor David had to get the U.S. government involved and they have been in talks with Brazil’s government to return the child. Even Secretary of State Hillary Rodham Clinton has gotten involved in the story and has been speaking with Brazilain officials. The U.S. House of Representatives was the first to get in on the story on David’s behalf.
